In Florida, the department in charge of annuities and insurance regulation is the Florida Office of Insurance Regulation (FLOIR). The mission of the FLOIR is "to ensure that insurance companies licensed to do business in Florida are financially viable, operating within the laws and regulations governing the insurance industry; and offering insurance policy products at fair and adequate rates which do not unfairly discriminate against the buying public."
Kevin M. McCarty serves as Florida’s Insurance Commissioner leading a 292-member team at the Office of Insurance Regulation (Office). He was appointed to this position in 2003 by the Financial Services Commission. McCarty’s comprehensive background spans a career of more than 27 years and includes extensive experience in all facets of the insurance industry.
McCarty works in close collaboration with other state insurance departments through his participation in the National Association of Insurance Commissioners (NAIC). He was elected to various positions on the NAIC Executive Committee, rising through the ranks to serve as its President in 2012, successfully passing the NAIC’s key initiatives for Actuarial-38 guidelines and principle-based reserving. McCarty is currently a member of numerous NAIC committees and chairs both the International Insurance Relations Committee and the Life Annuities/Unclaimed Property Task Force, which guides the national multi-state, multi-agency examination effort of life insurance companies and their asymmetrical use of the Social Security Administration’s Death Master File. A milestone in his career, this effort caused a significant change in the way life insurance companies either conduct searches to locate beneficiaries of a life insurance policy or report and remit unclaimed property to the states. To date, more than $8 billion has been returned to consumers and the states as part of these investigations.
The Florida Office of Insurance Regulation (Office) has primary responsibility for regulation, compliance and enforcement of statutes related to the business of insurance and the monitoring of industry markets.
